Britain’s elite Special Air Service (SAS) is facing a growing exodus as soldiers resign over fears they could face years of legal scrutiny for actions taken on the battlefield, according to a report in The Telegraph.
Several sources told the British newspaper that members of 22 SAS, the British Army’s most elite regiment, have applied for premature release amid anger over investigations into alleged war crimes in Afghanistan, Syria and Northern Ireland.
The debate is not confined to Britain.
American troops could face similar concerns if political leaders fail to distinguish between legitimate investigations and politically motivated campaigns, according to Executive Director of the Urban Warfare Institute John Spencer.

"I welcome timely investigations of allegations of violations," Spencer told Fox News Digital. "But want our leaders to protect all our forces, special or not, from agenda or politicized ‘witch hunts.’"
In Australia, the case of Victoria Cross recipient Ben Roberts-Smith has become a rallying point for veterans who fear elite soldiers could face years of legal battles after serving in combat.
Roberts-Smith, Australia’s most decorated living soldier, has denied allegations that he committed war crimes in Afghanistan. Earlier in April, Australian authorities charged him with five counts of murder related to his service in Afghanistan.
To many British veterans, the Australian case reinforces fears that the same trend could spread across other Western militaries, including the United States.
At least two SAS squadrons have been affected, with several current and former members describing the losses as a "threat to national security." The paper did not publish the precise number of departures for security reasons.
The resignations come as Prime Minister Keir Starmer’s government faces criticism over both defense spending and the treatment of veterans.
Britain’s armed forces have faced mounting scrutiny over their size and readiness in recent years. But the UK government says it is reversing that trend, reporting that total armed forces strength stood at 182,050 personnel as of Jan. 1, 2026, including 136,960 regular troops, an increase from the previous year.
The government also has pledged what it calls the largest sustained rise in defense spending since the Cold War, with military spending set to reach 2.6% of GDP by 2027, backed by an additional £5 billion this financial year and £270 billion in defense investment over the course of the current Parliament. Britain also has said it aims to raise defense spending to 3% of GDP by the end of the next Parliament.
Former and current soldiers said they believe Britain’s legal system has turned against troops who were sent to fight on behalf of the government.
"If a soldier discharges their weapon, they are almost certainly going to get a knock at their door one day," George Simm, a former regimental sergeant major of 22 SAS, told The Telegraph. "It feels like a betrayal and a break in the trust."
The controversy centers on ongoing investigations into British special forces operations.
A total of 242 special forces troops, including 120 still serving, are currently involved in legal inquiries costing roughly £1 million per month. Those inquiries involve operations in Afghanistan, Northern Ireland and Syria.
Critics say those investigations have created a culture in which soldiers fear that decisions made in combat would later lead to prosecution.
Andrew Fox, a former British Army officer and senior fellow at the Henry Jackson Society, a London-based think tank, told Fox News Digital the relationship between soldiers and the government has been badly damaged.
"Soldiering contains a pact between the government and those they employ to use lethal force," Fox said. "Soldiers will take human life within the rules set for them by international law, and in return, their governments should support them.
"This has been inverted, and international law has been weaponized and exploited by our enemies to persecute our soldiers. All too often, governments are coming down on the side of those enemies, not our troops."
Fox said it was understandable that some soldiers would no longer want to serve.
"Of course, law breaking should be punished, but we are seeing a breakdown in trust between governments and their armed forces when politicians allow troops to be hounded through the courts unjustly," he said.
Spencer said professional militaries depend on maintaining public trust through a strong internal justice system.
"A professional military holds the trust of its society because it lives by a strict ethical code, its laws, and its rules," Spencer told Fox News Digital. "That trust is what gives soldiers the unique authority to use lethal force in the worst conditions a human being can face."
Spencer said allegations of wrongdoing should be investigated quickly and fairly.
"We need investigations that move quickly and fairly on any credible allegation," he said. "If there's real evidence of wrongdoing under the law of armed conflict or the rules of engagement, then both the military and society must act on it. That's how you keep the trust alive."

At the same time, Spencer warned that some legal campaigns risk crossing the line into what troops perceive as politically motivated "witch hunts."
"I've seen too many human rights lawyers blur the line between basic human rights and the actual law of armed conflict," Spencer said. "They don't always understand the application of the use of force in context or the split-second chaos of combat. When that turns into what troops call witch hunts, it eats away at morale and readiness."
Spencer said governments have a responsibility both to investigate credible accusations and to protect troops from what he called agenda-driven campaigns.
"It's also the duty of the government to shield the military from agenda-driven witch hunts," he said. "A rigorous military justice system and honest self-policing are essential for an ethical force. Without them, the profession loses the very trust that lets it do its job."
Britain’s Ministry of Defense spokesperson told Fox News digital that, "While it is a longstanding policy of successive Governments to not comment on UK Special Forces, we are immensely proud of all our Armed Forces and their extraordinary contribution to keeping the UK safe at home and abroad."
"We are committed to ensuring that the legal framework governing our Armed Forces reflects the practical realities of military operations — and that those who served with honor are properly protected," he added, "Where the UK undertakes military action, it complies fully with UK and international law. We are clear that upholding those standards does not prevent our Armed Forces from conducting effective operations."
Former British military chiefs warned in an open letter to Starmer in late 2025 that soldiers increasingly believe they must worry about "not only the enemy in front of them but the lawyer behind them."
"Make no mistake," the retired generals wrote, "our closest allies are watching uneasily, and our enemies will be rubbing their hands."

Mexican President Claudia Sheinbaum indicated Monday that she would call for explanations regarding what U.S. and Mexican officials were doing when they died due to a car accident in Mexico.
Sheinbaum said her government would investigate the incident to ensure no laws were broken after the deaths on Sunday, adding that state governments must have authorization from Mexico’s federal government to collaborate with U.S. and other foreign entities "as established by the Constitution," according to The Associated Press.
The deadly incident, which killed two U.S. embassy personnel and two individuals with the Chihuahua State Investigation Agency (AEI), occurred after a drug-related operation in Mexico.
"It was not an operation that the security cabinet was aware of," Sheinbaum said, according to the AP. "We were not informed; it was a decision by the Chihuahua government."

In a statement issued Sunday, César Jáuregui Moreno, the Chihuahua state attorney general, announced the deaths "of the members of the State Investigation Agency, as well as two instructor officers from the United States Embassy, who died in an accident while returning from the operation to destroy clandestine laboratories in the municipality of Morelos," according to an English translation.
The attorney general indicated in another statement that there were no foreign agents involved in the operation and that it was not connected to the accident.

"With the above, he rules out the intervention of foreign elements, however, he specified that instructors from the United States were in the state and in a neighboring community, but for other purposes, such as teaching in the handling of drones," the office said. "He stated that around 80 officers participated in the seizure of the drug lab, 40 of them from the AEI and another 40 from the Secretariat of National Defense (DEFENSA)."

"They got into the vehicle at approximately two in the morning, and suffered the accident in which they lost their lives when it went off the road into one of the ravines in the area," Jáuregui Moreno said, also noting "there was never any involvement of any foreign agent in El Pinal."
He noted there "were no U.S. agents in the operation to secure the narco-lab," according to the AP.

The outlet reported that the Mexican Security Cabinet confirmed that the army and state prosecutor's office executed a joint effort over the weekend in Chihuahua targeting drug labs in the same place, Morelos.
U.S. Ambassador to Mexico Ronald Johnson said in part of a Sunday post on X, "We are deeply saddened by the tragic loss of two U.S. Embassy personnel, the Director of Chihuahua’s State Investigation Agency (AEI), and an AEI officer in this accident."
"We honor their dedication and tireless efforts to confront one of the greatest challenges of our time. Our thoughts and prayers are with them and their loved ones. This tragedy is a solemn reminder of the risks faced by those Mexican and U.S. officials who are dedicated to protecting our communities. It strengthens our resolve to continue their mission and advance our shared commitment to security and justice, to protect our people," he added.
The U.S. State Department did not provide further comment to Fox News Digital on Tuesday.

British counterterror police are investigating whether suspected Iranian proxies are behind a wave of arson attacks targeting Jewish sites in London, as a chief rabbi warned that such attacks are escalating.
The Metropolitan Police said specialized counterterror officers are probing fires at synagogues, Jewish-linked facilities and a Persian-language media company critical of Iran’s regime.
The latest incident caused minor damage to a north London synagogue Saturday night. No injuries have been reported in any of the blazes, which all happened within a few miles of each other.
Deputy Assistant Commissioner Vicki Evans said investigators are examining claims by a group calling itself Harakat Ashab al-Yamin al-Islamia, which has taken responsibility for several attacks. The group’s name means Islamic Movement of the Companions of the Right.

"We are aware of public reporting that suggests this group may have links to Iran. As you would expect, we will continue to explore that question as our investigation evolves," she said.

Authorities say the group — which Israel has described as a possible Iranian proxy — has also claimed synagogue attacks in Belgium and the Netherlands.

Police have flooded northwest London with additional officers after a series of incidents in recent weeks, including the torching of four Jewish charity ambulances in the Golders Green neighborhood on March 23.
Several suspects, ranging from teenagers to people in their 40s, have already been arrested and charged.
Chief Rabbi Ephraim Mirvis warned on X that "a sustained campaign of violence and intimidation against the Jewish community of the UK is gathering momentum."
"Thank God, no lives have been lost, but we cannot, and must not, wait for that to change before we understand just how dangerous this moment is for all of our society," he added.
Prime Minister Keir Starmer condemned the violence, calling the attacks "abhorrent" and vowing those responsible "will be found and brought to justice."
The threat level rose further after the group released a video claiming it would target Israel’s embassy in London with drones carrying hazardous substances. Police shut down nearby Kensington Gardens while investigating suspicious items but said no dangerous materials were found.

Testimony at a major South African corruption inquiry was briefly overshadowed Tuesday by an unscripted moment — a suspended police chief with a tissue stuck to his brow.
Julius Mkhwanazi, the former deputy chief of the Ekurhuleni Metropolitan Police Department, was testifying before the Madlanga Commission when the awkward moment unfolded.
Mkhwanazi, who was suspended in November 2025 amid misconduct allegations, had been wiping sweat from his face after answering questions from the commission.
Part of the tissue, however, remained stuck to his head.

The Madlanga Commission is a public inquiry probing allegations of corruption and political interference in South Africa’s justice system. The current inquiry has been hearing testimony from current and former law enforcement officials.
Mkhwanazi has been under scrutiny since an internal audit recommended his suspension as part of a broader probe into alleged misconduct.
Police in London are on the hunt Wednesday for two masked suspects behind an attempted arson attack on a synagogue that is being treated as an "antisemitic hate crime."
The United Kingdom’s Metropolitan Police said the individuals, who were wearing "dark clothing and balaclavas," approached the synagogue in the Finchley neighborhood shortly after midnight Wednesday and "threw two bottles, suspected to contain petrol, and a brick at the building."
"We are aware of the significant concern that this incident will cause in the community, particularly in the wake of the arson attack in Golders Green last month," Detective Chief Superintendent Luke Williams said. "We are working with the affected synagogue and continuing to meet with community leaders."
"I would like to reassure the community that we take incidents of this nature extremely seriously and detectives are working urgently to identify the suspects," he added.
UK PROSECUTORS CHARGE 3 IN ARSON ATTACK ON JEWISH AMBULANCES IN LONDON
Police said neither bottle ignited and no damage or injuries were reported.
British prosecutors earlier this month charged three suspects — ages 17, 19 and 20 — in an alleged arson attack targeting Jewish community ambulances in north London.
The March 23 incident unfolded at around 1:45 a.m. in the Golders Green neighborhood, where four ambulances operated by a volunteer emergency service serving the Jewish community were deliberately set ablaze in a synagogue parking lot.

The International Criminal Court’s Chief Prosecutor, who brought charges against Israel’s prime minister and former defense minister on war crimes and crimes against humanity, is facing disciplinary proceedings against him over allegations of sexual misconduct.
After more than a year-long process of investigating the claims that Karim Khan engaged in sexual misconduct with a subordinate staffer, the Bureau of the Assembly of States Parties (ASP) has voted in favor of pursuing disciplinary proceedings against Khan, Reuters reported.
According to The New York Times, the alleged victim revealed the sexual contact with Khan to her husband and several colleagues in April 2024. After colleagues confronted Khan in May, the judges’ report cites a witness who noted that Khan "jumped at the ‘lifeline’ of an alternative narrative when another colleague present said he ‘suspected whether Mossad played a role behind the scenes.’"
ICC PROSECUTOR BEHIND NETANYAHU ARREST WARRANTS STEPS ASIDE AMID SEXUAL MISCONDUCT PROBE
Just weeks later, Khan filed arrest warrants against Israeli Prime Minister Benyamin Netanyahu and former Israeli Defense Minister Yoav Gallant. The Trump administration sanctioned Khan in February 2025 as a response to the war crimes warrants against the Israeli officials.
Eugene Kontorovich, a professor at George Mason University, told Fox News Digital that the fact that Khan "specifically blamed the Mossad for his problems shows he is fundamentally compromised and the investigation that he launched… in any normal legal system would be dismissed with extreme prejudice."
He said it was a sign of "how broken" the ICC is "that such a politicized investigation would be allowed to proceed."
The disciplinary action came as 15 member states voted in favor of moving forward to discipline Khan, with four votes against and two abstentions. In a letter read aloud during the meeting, prosecutors’ office officials noted they were not in favor of Khan remaining in his position as chief prosecutor.
SCANDAL LEAVES INTERNATIONAL CRIMINAL COURT GRASPING FOR LEGITIMACY AMID PROBE OF ISRAEL
The vote represented a change from the consensus of three judges who determined last month there was insufficient evidence to prove the allegations against Khan "beyond a reasonable doubt," according to the New York Times report. The judges based their findings on a United Nations’ investigation done by the Office of Internal Oversight Services (OIOS) turned up more than 5,000 pages of evidence. While the U.N. investigation report determined that Khan had "non-consensual sexual contact" with the employee, the judges’ report found there was no evidence of misconduct.
In a press release, the Association of International Criminal Law Prosecutors (AICLP) noted "structural deficiencies" made clear through the proceedings against Khan.
Among these are an Independent Oversight Mechanism whose processes were "inadequate to the task" when it closed an inquiry into the assault after the alleged victim "declined to file a formal complaint" and claimed she feared retaliation. "The Court cannot credibly prosecute the gravest crimes against persons while tolerating a culture in which its own staff are inadequately protected," the AICLP argued.
Khan’s alleged retaliation against the staff who supported the complainant further concerned the AICLP. "We observe that the standard for fitness to lead the world’s foremost international criminal prosecution office is not simply the absence of proven misconduct beyond reasonable doubt," the AICLP wrote. "It also includes the demonstrated capacity to command the trust of the institution’s own staff, and that trust, on the evidence now before the Assembly of States Parties, appears to be deeply and publicly fractured."
The AICLP believes that "a prompt, principled, and transparent resolution is not only a matter of fairness to the individuals directly involved, but a prerequisite for restoring the operational integrity of an Office on which the cause of international criminal justice depends."
Prior to the announcement of the Bureau’s decision to pursue disciplinary action against Khan, the ICC directed Fox News Digital to a press release in which the President of the ASP "expresse[d] concern at the recent media reporting concerning the ongoing disciplinary process regarding the Prosecutor of the International Criminal Court." The ASP President called "for due respect for the privacy and the rights of all parties concerned, as well as the integrity of the ongoing process."
Peter Gallo, formerly an investigator with the OIOS, told Fox News Digital that "trying to deflect attention away from the facts of the allegation by blaming Israel is an indication of the anti-Israel bias which clearly exists, and which reduces the ICC to a tool of political warfare rather than any kind of court of justice."
Gallo noted that "the panel of judges appear to be hung up on there being insufficient evidence to meet the ‘beyond all reasonable doubt’ standard," and questioned why "one particular international civil servant [should] be subjected to a ridiculously high standard of proof when lower ranking staff are not."
The ICC did not respond to follow-up questions about whether investigations into Gallant and Netanyahu will continue should Khan be removed from his post.
The OIOS did not respond to Fox News Digital’s request for comment on its report.

The multimillion-dollar Kensington properties sit next to the high-profile embassy compound and were identified by UK media, drawing on findings from a yearlong probe into Khamenei’s potential overseas assets.
The Times of London reported on March 5 that the one building "sits next to the Israeli Embassy on Palace Green," placing the residences in exceptional proximity to one of Israel’s most sensitive diplomatic sites.

The revelations stem from a Bloomberg investigation that alleged that the Khamenei portfolio could span multiple countries and include high-value real estate in London, totaling around $138M as well as assets in Europe and the Gulf.
The two London apartments were reportedly acquired in 2014 and 2016 via intermediaries and occupy upper floors of the building, offering a direct vantage point toward the rear of the Israeli embassy compound, UK media reported.
A terrorism specialist quoted in reports said the positioning effectively means "Iran owns the view into the back of the Israeli Embassy from less than 50 meters away," describing the situation as a potential "serious security breach."

Further details from Bloomberg’s investigation indicated that a businessman acted as a financial conduit, buying up high-end properties on Khamenei’s behalf and channeling funds through a network of investments.

The investigation also found that 11 mansions on London's "Billionaire’s Row" were purchased using an Isle of Man shell company.

Khamenei, 56, has been viewed as a powerful figure within Iran’s ruling establishment, ultimately becoming the leading successor to his father, who was killed in a Tehran compound strike on Feb. 28.
So far, since he was selected by Iran's Assembly of Experts, he has not been seen in public.
